The Petition of George CREMER oldest son and Heir at law of Henry CREMER late of Warrington Township in the said county of York deceased who died Intestate, was read to the court.
Setting forth that the said Intestate died seized in his demise as of fee of two pieces or tracts of land with the buildings and appurtenances thereunto belonging situate in Warrington and Newberry Townships, the one in Warrington containing about one hundred and eight acres of land adjoining lands of John MYER and Abraham BOYER, the big Conewago Creeks and lands of other persons which was the dwelling place of said Intestate, The other of said two tracts situate in a Newbery, containing about sixty acres adjoining said Creek, Abraham MEYER, Michael DRAWBACK and Jacob KIRKHARD, that he left to survive him a Widow named Elizabeth and nine children lawful issue namely Louise the wife of George HORN, George the Petitioner, Elizabeth the Wife of Paul GEHR, Mary Barbara, Henry, Susanna, Catharine and Sarah who now hold the said lands and appurtenances together and undivided. And praying the Court to award an Inquest to make partition of the premises among the said. Widow and children, but if the same will not admit of such partition without prejudice to or spoiling the while, then to inquire whether the same, will conveniently accommodate more than one of the said Children, and to make a just appraisement of each part into which the same may be divided
but if the same will not admit of partition or Division in either case then to value and appraise the whole undivided according to law.
Whereupon it is considered by the Court and ordered that the Sheriff of the County of York in his proper person with twelve good and lawful men of his Bailwick in the presence of all the parties who shall chose to attend, of the Guardians of such of them as are minors. (They respectively having due and legal notice thereof) Do hold and Inquest on the said Tracts of land and make partition thereof to an amongst the Widow and Children of said Intestate by metes and bounds and value and appraise each part separately, if the same will admit of such partition without prejudice to or spoiling of the whole, but if they find that the same cannot be so divided among the children of said Intestate without prejudice to or spoiling the whole that they their will and truly inquire whether the said premises will conveniently accommodate more than one of the children of said Intestate, and if they so fine That they then well and truly partition the same into so may parts as the same will bear or accommodate by metes and bounds and will and truly value and appraise each prepart ?. But if the said Inquest shall find that the said premises will not admit of partition at all without prejudice to a splitting the whole, Then that they well and truly value and appraise the whole undivided according to the directions of the Act.
General Assembly of this Commonwealth in such case made and presided. And that the said Sheriff Do make return of such Inquisition (annexed to this order) as well under his own hand and seal as the hands and seals of the said Inquest, to the next Orphan's Court after the same is held.

Esquire High Sheriff of York County, Came into Court and mate Retain of a ----- --- of this Court, Whereby, he was Commandeth to make partition of two pieces or tracts of land with the buildings a appurtenances, thereunto belonging situate in Warrington and Newbery Townships, the one in Warrington containing about one hundred and eighty acres, adjoining lands of John MEYER and Abraham BEYER, the Big Conewago Creek, and lands of other persons, the other tract situate in Newbury Township, containing about sixty acres adjoining land of Abraham MEYER, said Creek, Michael DRACBACH and Jacob KIRKHART, late the Estate of Henry CREMER deceased, who died Intestate to and amongst Widow and Children of decd. Intestate, if the same would admit of such partition without prejudice to or spoiling the whole, otherwise to value and appraise the whole together and undivided and by the said Sheriff's return on said order and on Inquisition there unto annexed it appears that the said Tracts of land would admit of partition so as to accommodate two of the children of said Intestate, And that the Inquest have valued and appraised the Track of land in Warrington Township containing about one hundred and eight acres with the appurtenances at the sum of four Thousand seven hundred and ninety seven dollars and fifty cents, lawful money of Pennsylvania. And the Tract of land in Newbury Township containing about sixty acres at the sum of six hundred and ninety two Dollars, and ninety cents lawful money aforesaid, which valuation the Court do hereby Confirm respectively And now came into Court George CREMER, oldest son and Heir at Law of said Intestate and prayed to be permitted to take the Tract of land in Warrington Township at the Return of Valuation. Whereupon the Court Decree the same to him he praying the Widow and other Children of said Intestate, their respective shares, thereof And it is ordered and Decreed by the Court that the said George CREMER be allowed the sum of thirty seven dollars and eighty six cents, the costs and expenses of these proceedings That he pay unto Elizabeth the widow of said Intestate, yearly and every year during her natural life the sum of ninety five dollars and thirty nine cents lawful money aforesaid, the first payments Whereof to be made in one year, from the first day of April next in full for the right or claim of dower of the said Widow, out of the aforesaid Tract of land situate in Warrington Township That he retains in his hands , the sum of three hundred and fifty three Dollars, and thirty cents and a half, and after the death of the said Widow, the further sum of one hundred and seventy six dollars and sixty five cents in full for his share of the said Tract of land in Warrington Township, that he pay unto Louisa intermarried with George HORN, in right of said Louisa. Elizabeth, intermarried with Paul GEHR, in right of said Elizabeth, Mary CREMER, Barbara CREMER, Henry CREMER, Susanna CREMER Catharine CREMER and Sarah CREMER or unto the Guardians of such of them as are minors, each the sum of three hundred and fifty three dollars and thirty cents and a half lawful money aforesaid in one year from the first day of April next, with interest from the said first day of April next and after the death of the said Widow the further sum of One hundred and seventy six Dollars and sixty five cents each, lawful money aforesaid, in full for their respective shares of the said Tract of land in Warrington Township, as right of the children of said Intestate, which said several sums of money as the full amount of the valuation of the aforesaid Track of land in Warrington Township. And it is further ordered and Decreed by the Court, That upon the said George CREMER him making the several payments aforesaid or giving good security for the same. That thereupon he the said George CREMER his Heirs and Assigns Do Hold the said Tract of land for the same Estate and in as full and ample a manner as the said Henry CROMER deceased his father in his life time held and enjoyed the same.
Executed and discharged from these further claims of the said Widow and other children of said Intestate and all persons claiming to to claim the same, under them or any or either of them.

George CREMER and Zachariah SPANGLER Respectively, bound unto Jacob HOSTETTER and George BARNITZ Esquires, Judges of the Orphans Court of York County, in the sum of nine Thousand five hundred and ninety five dollars to be levied of their goods and Chattels, lands and Tenements Respectively, upon this condition. That the said George CREMER, shall and Do well and truly pay unto the Widow and other children of the said Henry CREMER deceased, their respective shares, dividends and purpants of, in and to that part of the Real Estate of the said Henry CREMER the Intestate which the said George CREMER, has taken at the Return of Valuation, agreeably to and in the manner, days and times, set forth and appointed for payment thereof, in and by the foregoing distribution and Decree, Then this Recognizance to be void therewise to be and remain in full force and virtue.

Whereas Henry CREMER late of Warrington Township York County, PA died intestate seized of a tract of land with the appurtenances which was appraised by.... in the Orphans court of said County in partition and was on the third day of January A.D. 1844 accepted by George CREMER , the said eldest son, at the valuation made thereof and whereas the said tract of land adjoining lands now of John MYERs heirs, Henry EPPLEY, Joseph UPDEGRAPH, Ezekiel A. ...? and Conewago Creek in said Township has become the property of Philip FAHS and Michael ESHENFELTER and the said Philip FAHS has contracted to convey his part to Jonas SPANGLER and there is yet and to the heirs of said Henry CREMER out of that part of the valuation made aforesaid which remained charged for the benefit of the Widow who is now dead, the sum of $1,009.33.
Now therefore in consideration debt to said ESHENFELTER and SPANGLER have this date paid to each as of the ... part of the ... sum viz: $123.26.
We namely George CREMER,

Samuel BUTLER in right of his wife Susannah,
Jacob BUCHER by right of his wife Catharine and
George HOFFMAN in right of his wife Sarah, and

  Research Notes:

Henry Cremer of York Co., PA is the subject of this census study below. At his death, in estate papers filed in 1811, John Myer and Abraham Beyers are listed as adjoining land owners. Finding the subject of this study is somewhat difficult in that Henry Cremer/Cramer/Kremer/Creamer appears many times in York Co. Finding known neighbors of our subject could help determine the correct Henry Cremer. 1810 finds John Myers and Abraham Beyer living next to or near our subject. Also nearby is Jacob Kline. I will thus try to follow these people through different census years in order to establish the correct census record for our subject.

Henry Cremer, John Myers, Abraham Beyers, and Jacob Kline appear near each other through several census years. The 1800 census below shows such a connection (families) in Manheim Township of York Co. but they are not the correct subjects. This is described here only to show the difficulty in finding our particular subject. Below this Manheim study is the correct subjects of our study.
